The subject of these general conditions of sale (hereinafter, 'General Conditions') is the discipline of the purchase of products via computer network from the website www.remonellaroccia.it
Owner of the site is Remo nella Roccia by Aleksandra Kniazeva.
ACCEPTANCE OF TERMS AND CONDITIONS OF SALE
All purchases of products made through the site by users who have access to the site are governed by these general conditions and the so-called 'consumer' code (Legislative Decree 206/2005, section II, on distance contracts, articles 50-67) and the rules on electronic commerce (Legislative Decree 70/2003).
By concluding the purchase contract, the customer accepts and undertakes to observe these terms and conditions.
The customer is invited to read carefully, before making any purchase, these terms and conditions and, once completed the purchase process, print or store them in the manner preferred.
Remo nella Roccia can change, at any time and without notice, the content of the terms and conditions.
Purchase contracts will be subject to the terms and conditions published on the site at the time the customer sends the order.
The products offered are described in detail on the home page of the site, within their respective sections, divided into categories.
The visual representation of the products on the website, is normally the photographic image of the products and has the sole purpose of presenting them for sale about the exact correspondence of the image. This, especially for the chromatic aspects of the products and / or packaging.
In case of necessary difference between the image of the product published on the site and the written description of the product itself, the product description is always valid.
PURCHASING PROCEDURE
The customer can purchase the products in the Remo nella Roccia electronic catalogue by following the technical procedures for accessing it.
The publication of the images and product sheets displayed on the site constitutes an invitation to the public to make a proposal.
Any order placed by the customer has proposed negotiation value and implies full knowledge and acceptance of these general conditions.
The correct order proposal is confirmed by Remo nella Roccia by means of an automatic email reply sent to the address communicated by the customer.
This automatic e-mail will indicate a 'serial number' to be used in any subsequent communication with Remo nella Roccia and will contain, in addition to the information required by law, all the information communicated by the customer who undertakes to verify its correctness and to promptly report any corrections or modifications.
Any additional costs caused by errors in communication and modification of data not reported in time will be borne exclusively by the customer.
Each order can be viewed by the customer on the site, in his so-called 'personal area'.
Payments by credit card and PayPal mode will be subject to approval by the system (see payment methods section).
Remo nella Roccia will issue an invoice for the order and forward it by email to the customer.
For the management of the invoice the data provided by the customer at the time of order will be used.
No data changes will be possible after the invoice has been issued.
Remo nella Roccia will issue an invoice at the time of shipment of the product ordered.
The purchase contract between Remo nella Roccia and the customer is concluded with the receipt of the payment by Remo nella Roccia.
PRICES OF PRODUCTS
The price of the products included in the online catalogue published on the site is without of VAT (Remo nella Roccia products have no VAT by article 1, part 58 law n. 190/2014 special rules) but not customs duties (where applicable) and shipping costs. The latter charges are indicated when viewing the order summary and before the final purchase and vary depending on the service and destination selected. Any customs duties and taxes for foreign sales are the sole responsibility of the customer.
DELIVERY
The products will be shipped by courier to the address specified by the customer at the time of order. Deliveries are made from Monday to Friday, during normal business hours, excluding holidays. The delivery is considered completed when the product is made available to the customer at the address specified in the order form. In case of non-delivery due to the absence of the recipient at the specified address, the courier will attempt delivery the next day. In case of non-delivery the next day due to the absence of the recipient, the courier will attempt to contact the customer to schedule a new delivery in the next days. In case of further absence of the recipient, the products ordered will be returned to Remo nella Roccia which will send an e-mail message to the customer. All costs related to any subsequent deliveries will be borne by the customer. At the time of delivery of the products by the courier appointed by Remo nella Roccia, the customer must carefully check that the packaging is intact and not damaged or tampered with and that the number of pieces is as indicated in the transport document. Any damage to the packaging or the mismatch in the number of pieces, as indicated in the transport document, must be immediately reported to the courier and then promptly reported to Remo nella Roccia by e-mail at info@remonellaroccia.it specifying the order number.
TIMING
Orders will be processed in approximately 3-5 working days from the date of their receipt. Personalized orders or big orders might request 10 days of production. Delivery timing in Italy normally 2/3 days, in Europe normally 3/5 days, other countries normally 5/7 days.
PAYMENT METHODS
You can pay by credit card, PayPal account or bank transfer. The accepted credit cards are: MasterCard, Visa, Visa Electron, American Express, Carta Aura, PostePay. If the PayPal system refuses to authorize the payment, the order will be considered void, the data to make the transfer will be displayed at the time of choice of payment method. Your order will be valid from the moment the bank transfer is received by Remo nella Roccia.
RIGHT OF WITHDRAWAL
Purchases made on the www.remonellaroccia.it website are regulated by these general conditions and by the regulations in the "acceptance of terms and conditions of sale" section. Under Articles. 64 et seq. of Legislative Decree no. 206/2005 ('Consumer Code'), the consumer has the right to terminate the purchase contract for any reason and without explanation of the conditions below. To exercise this right, the customer must send a communication within 10 (ten) working days from the date of receipt of the goods to info@remonellaroccia.it indicating name, address, product detail (code) and number of invoice. Then the customer must return the product within ten working days from the date of receipt. In any case will the withdrawal be valid without prior notice to the customer. The customer is responsible for any matter concerning the products until they are received by Remo nella Roccia. The cost of the refund will not be reimbursed unless the item received by the customer has been sent in error, or has been delivered damaged. The integrity of the goods to be returned is an essential condition for the exercise of the right of withdrawal. It is sufficient that the goods are returned in perfect condition and complete with labels and packaging. Remo nella Roccia will not accept items returned worn or without labels and packaging or that show clear signs of previous use. Failure to return the goods within the prescribed period will result in disqualification from the right of withdrawal. Customs duties and sales taxes are not refundable under any circumstances. Once verified the integrity of the returned product and compliance with the procedures, Remo nella Roccia will refund the customer the amount paid for each product for which the right of withdrawal has been exercised. The refund will be made within 30 (thirty) days from the receipt of the products. Remo nella Roccia will refund the full value of the order or the value of individual products returned in case of partial withdrawal by bank transfer or other methods specifically agreed with the customer. Please note that, in accordance with current regulations, in this case Remo nella Roccia will refund the customer the amount paid for the returned products excluding the costs necessary to return them. How specified by point C of article 59 (exception from the right of withdrawal), personalized goods are excluded from this right.
PRODUCT NON-CONFORMITY AND AFTER-SALES SERVICE
The products offered on the site comply with the national and EU regulations currently in force at Italia. The images and colors of the products published on the site may differ from the real ones due to the local settings of the system and/or the tools used to display them. In case of lack of conformity of the purchased products with respect to the written description published on the site and in case of faulty or defective product, the customer has the right to replacement of the non-conforming goods within 10 (ten) days. In case of breakage of one or more items, the customer must contact customer service at info@remonellaroccia.it indicating in the message the reference code of each individual product and the date of purchase. Any shipping charges/taxes are the responsibility of the customer.
COMMUNICATIONS AND COMPLAINTS
All communications or complaints from customers to Remo nella Roccia in relation to purchase contracts, must be forwarded through the email info@remonellaroccia.it
INTELLECTUAL PROPERTY RIGHTS
Remo nella Roccia is a registered trademark. All trademarks (registered and unregistered), as well as any work of genius, sign or name, image, photo, graphic or written text and more generally any other intangible asset protected by copyright laws and international conventions on intellectual and industrial property reproduced on the site are the exclusive property of Remo nella Roccia and/or its licensors. Access to the site and / or purchase does not give the customer any rights over the same. Any use, even partial, of the same is prohibited without the prior written consent of Remo nella Roccia and/or its licensor, in whose favor all rights are exclusively reserved.
PLACE OF JURISDICTION
Any dispute relating to the interpretation and execution of the contracts in accordance with these terms and conditions will be resolved before the competent Judicial Authorities in accordance with applicable legislation.
